New California Laws Focus on the Designated (and the) Survivor

In the television series Designated Survivor , HUD Secretary Tom Kirkman is named the designated person to take over the presidency if other members in the presidential line of succession perished all at once. Two of California’s most recent laws seem to use this TV show for inspiration, adding leave protections to the designated and the survivor. The DesignatedOne of the leave bills recently signed into law, AB 1041 , expands the protections of both the California Family Rights Act and California Paid Sick Leave law. Notably, unlike in tv-land, the “designated person” is not a potential successor to the office of the President. California modeled its law after similar laws in Oregon, Connecticut, New Jersey, Colorado, and municipalities like Los Angeles, that have previously passed paid leave laws covering chosen families.

Epic Fail: Fortnite Creator to Pay $520 Million FTC Settlement

Epic Games, Inc. (“Epic”) agreed to pay a combined $520 million in two “record-breaking settlements” on Monday. The settlements resolve alleged violations of both the Federal Trade Commission Act (the “FTC Act”) and the Children’s Online Privacy Protection Act (the “COPPA Rule”). Epic is the creator of Fortnite, a popular cross-platform game played by more than 400 million users worldwide. The COPPA Rule does not mandate the method a company must use to obtain parental consent. Epic must also delete personal information previously collected from Fortnite users in violation of the COPPA Rule unless the company obtains verifiable parental consent to retain such data.

Regulatory Update and Recent SEC Actions - January 2023

REGULATORY UPDATESRecent SEC Leadership ChangesThe Securities and Exchange Commission (the “SEC”) announced that Megan Barbero, currently SEC Principal Deputy General Counsel, will be appointed General Counsel, effective January 31, 2023. Broker-dealers that qualify as “introducing brokers” would be exempt from many of the operative provisions of the proposed rules so long as they meet certain requirements. The proposed amendments revise the standards for making liquidity determinations, amend certain aspects of the liquidity categories, and require more frequent liquidity classifications. The comment period for the proposed amendments will remain open for 60 days after publication in the Federal Register. The rule amendments that address representations of fees and expenses that could be materially misleading will apply on the effective date.
